Defense medical toxicologist has been the only witness to testify so far Friday morning.
Dr. Lawrence Guzzardi told the court that based on testimony about the amount of alcohol consumed by Christopher Johnson on Nov. 11, 2010, he could have had a blood alcohol content of between .15 and .22 percent around 10:30 p.m., when Officer David Grove was shot.
Defense attorney Kristin Rice is arguing that Johnson was intoxicated to a level where he could not develop an intent to kill.
District Attorney Shawn Wagner rebutted that by Johnson shooting a deer with a .22-caliber rifle by reaching across the passenger seat while holding a spotlight, he did show an intent to kill.
